1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of Echify (the "App" and "Platform"), operated by Echify Inc. ("Echify", "we", "us", or "our"). By creating an account, accessing, or using Echify, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility & Types of Accounts

You must be at least 13 years old to use Echify and at least 18 years old (or the age of legal majority in your jurisdiction) to create a seller or business account, connect payment methods, or receive payouts. By using Echify, you represent that you meet these requirements and that you are not prohibited from using the Platform under applicable law.

Echify supports multiple types of users, including:

• Viewers / Buyers – users who browse content and purchase products or services.
• Creators – users who publish content and may earn commissions based on their activity and referrals.
• Sellers / Businesses – users who list and sell products or services to other users on the Platform.

3. Account Registration

Creating an account on Echify is free. You agree to provide accurate and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account. If you believe your account has been compromised, you must contact us immediately.

4. Content & Community Guidelines

Echify is a social commerce platform that allows users to post content, promote products or services, and interact with others. You are solely responsible for any content you create, upload, post, or share on or through the Platform ("User Content").

You agree that you will NOT post, upload, or share:

• Child sexual abuse material (CSAM) or any content involving child sexual abuse or exploitation (CSAE), including depictions, threats, or promotion of sexualized content involving minors.
• Nudity or sexually explicit content that violates applicable app store policies or local laws.
• Content that is hateful, harassing, discriminatory, threatening, or incites violence or self-harm.
• Graphic violence, extreme gore, or content intended to shock or terrorize.
• Illegal goods or services, including drugs, weapons, or fraudulent schemes.
• Content that infringes or violates the intellectual property, privacy, or other rights of any person or entity.

Echify may use automated tools and human review to moderate content. We reserve the right, in our sole discretion, to remove or restrict any content and to suspend or terminate accounts that violate these Terms or applicable laws.

5. Child Safety & Reporting Harmful Content

Echify has zero tolerance for any form of child sexual abuse material (CSAM) or child sexual abuse and exploitation (CSAE). Any account found to be creating, uploading, distributing, or engaging with such content will be immediately suspended and reported to the appropriate authorities and relevant child protection organizations, as required by law.

To help keep the community safe, each piece of content in Echify includes a "Report Post" option that allows users to report harmful, abusive, or illegal content directly from within the app. You agree to use this feature responsibly.

You may also report concerns involving minors, exploitation, or other serious safety issues by contacting our dedicated child safety team at safety@echify.com. We prioritize and investigate these reports as quickly as possible.

6. E-Commerce, Fees & Payments

Echify enables sellers and businesses to list products and services and allows buyers to purchase them through integrated payment solutions. All payments are processed by our third-party payment partners such as Stripe, Apple, Google, or other approved providers. By completing a transaction, you also agree to the applicable terms and policies of these payment processors and app stores.

Echify charges transparent transaction fees and/or commissions on certain sales and earnings, including commissions paid to creators for eligible referrals. Applicable fees are displayed in the App or communicated separately and may be updated from time to time.

Payouts to sellers and creators are subject to successful identity verification, compliance checks, and the rules of our payment partners and banking institutions. In some regions, users may not be able to receive cash payouts and may instead use their balance within the Platform where permitted.

7. Orders, Refunds & Disputes Between Users

Purchases made through Echify are agreements between buyers and sellers. Echify does not manufacture, store, or ship products and is not a party to the contract of sale between users. Sellers are solely responsible for the quality, safety, legality, and delivery of their products or services.

Refunds, cancellations, and returns are governed by the seller's policies and applicable consumer laws. Where required, Echify may provide tools to facilitate communication and dispute resolution, but Echify is not obligated to intervene in disputes between users.

8. In-App Purchases & Platform Rules

Some features or digital items within Echify may be offered as in-app purchases. When you make an in-app purchase through the Apple App Store or Google Play Store, the transaction is processed and governed by that store's terms and policies. Any billing inquiries, subscription management, or refunds for such purchases must be handled through the respective store.

9. Intellectual Property

Echify and its logos, trademarks, designs, and other proprietary materials are owned by Echify Inc. or its licensors and are protected by intellectual property laws. Except for the limited license granted below, you obtain no rights to our intellectual property.

By posting User Content on Echify, you grant Echify a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, translate, display, and distribute your content on the Platform solely for the purposes of operating, promoting, and improving Echify. You represent that you have all rights necessary to grant this license.

10. Privacy

Your use of Echify is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy. Please review it carefully.

11. Suspension & Termination

We may suspend or terminate your access to all or part of Echify at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or created risk or possible legal exposure for us, other users, or third parties. You may stop using the Platform and close your account at any time.

12. Disclaimers & Limitation of Liability

Echify is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that the Platform will be secure or free of harmful components.

To the maximum extent permitted by law, Echify Inc., its affiliates, and their directors, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Platform. Our total liability for any claim arising out of or relating to the Platform shall not exceed the amount you have paid to Echify (if any) in the twelve (12) months preceding the claim.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or other operational needs. When we make material changes, we will update the "Last Updated" date above and may provide additional notice within the App. Your continued use of Echify after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles, unless otherwise required by the laws of the country where you reside.
